Terms of Service
Last updated: [EFFECTIVE_DATE]
Acceptance
By creating an account or using ExamPlatform, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the platform.
If you are under 18, your parent or legal guardian must read and agree to these Terms on your behalf before you use the platform.
These Terms are governed by Indian law. Any disputes will be subject to the exclusive jurisdiction of courts in [JURISDICTION], India.
The service
ExamPlatform provides:
- An exam attempt platform for students — free and paid mock tests, practice exams, and scorecards.
- A studio for institutes and educators to create, publish, and monetise exams.
- A community layer — discussions, reviews, leaderboards.
We are an intermediary under the Information Technology Act, 2000. We do not create exam content — institutes and creators do. We are not responsible for the accuracy, completeness, or legality of any exam content published by third parties on the platform.
Student rules
When using ExamPlatform as a student or exam-taker, you agree to:
- ✓Not share question content from any exam publicly, on social media, or with other candidates during or after an exam attempt.
- ✓Not use automated tools, scripts, bots, or browser extensions to answer questions or manipulate exam behaviour.
- ✓Not attempt an exam on behalf of another person or allow another person to attempt an exam using your account.
- ✓Not attempt to extract the full question paper — questions are served one at a time by design, and any attempt to retrieve the full set will be detected and logged.
- ✓Not tamper with the exam timer — the timer is controlled server-side; any client-side manipulation will be detected and may result in your session being voided.
Violation of these rules may result in immediate score disqualification, account suspension, or a permanent ban — at our sole discretion.
Creator / institute rules
By publishing an exam on ExamPlatform, you confirm that:
- ✓You own the rights to all content in your exams, or have a valid licence to use it.
- ✓Your content does not infringe any copyright, trademark, trade secret, or other intellectual property right.
- ✓Your content is not defamatory, obscene, hateful, illegal, or otherwise in violation of Indian law.
- ✓Questions and answers in your exam are accurate to the best of your knowledge.
- ✓You are responsible for correcting content errors reported by students in a timely manner.
ExamPlatform reserves the right to remove any content that violates these rules or our community standards without prior notice. Repeat violations may result in institute suspension.
Content ownership
Content you create (questions, exams, institute descriptions, thumbnails) remains your intellectual property.
By publishing content on ExamPlatform, you grant us a non-exclusive, royalty-free, worldwide licence to display, distribute, reproduce, and promote your content on the platform and in marketing materials (e.g. featured exam cards, social media promotion).
This licence ends when you delete the content or close your account. Deleting content removes it from public view, but copies that have already been distributed (e.g. in cached leaderboards or scorecard exports) may persist briefly.
Platform rules for all users
The following are prohibited on ExamPlatform for all users:
- Harassment, threatening, or targeted abuse of any user or creator
- Hate speech based on religion, caste, gender, ethnicity, or disability
- Spam, unsolicited promotional messages, or phishing
- Impersonation of another person, institute, or organisation
- Uploading or distributing malware, viruses, or malicious code
- Attempting to breach platform security, test for vulnerabilities without authorisation, or access another user's account
- Sharing or soliciting child sexual abuse material (CSAM) — we report all such incidents to law enforcement
We comply with lawful takedown requests under the IT Act, 2000 and the IT (Intermediary Guidelines) Rules, 2021.
Payments (when enabled)
When payments are enabled: all prices are displayed in Indian Rupees (INR) and include 18% GST. All transactions are processed by Razorpay. By completing a payment, you also agree to Razorpay's terms at razorpay.com/terms.
Refunds are governed by our Refund Policy.
Limitation of liability
ExamPlatform is provided "as is". We do not guarantee:
- That the platform will be available 24/7 without interruption or error
- That exam content published by creators is 100% accurate or up-to-date
- Any specific exam results, scores, or career outcomes
To the maximum extent permitted by Indian law, our total liability for any claim arising out of these Terms or your use of the platform is limited to the amount you paid us in the 3 months preceding the claim. For free users, our liability is ₹0.
We are not liable for indirect, incidental, or consequential losses, including lost data, lost revenue, or exam disqualification by third-party bodies.
Termination
We may suspend or permanently terminate accounts that violate these Terms, with or without prior notice depending on the severity of the violation.
You may delete your account at any time from Account Settings → Delete Account. Deletion is irreversible. Certain data may be retained as required by law even after deletion — see our Privacy Policy.
Dispute resolution
Disputes should first be raised with us at [SUPPORT_EMAIL]. We will make a good-faith effort to resolve them within 30 days.
If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in [JURISDICTION], India.
Nothing in these Terms limits your rights under the Consumer Protection Act, 2019 or any other applicable Indian consumer protection law.
